Why this Matters: 

Plaintiffs challenge HHS and EEOC’s interpretation of federal civil rights protections against sex-based discrimination. They claim that the agencies’ rules and guidance interpreting sex-based discrimination as including gender identity and sexual orientation, which would require providing access to gender-affirming care, abortion care, and fertility care, violate the Religious Freedom Restoration Act, the First Amendment, and the Administrative Procedure Act. Women and sexual minorities face various structural barriers in accessing health care services and have faced worse health outcomes.

Potential Impact:
