Plaintiffs, nonprofit organizations that support family planning and preventive health care services, allege that the Department of Health and Human Services unlawfully imposed new conditions on federal funding under the Title X Family Planning Program in violation of the Administrative Procedure Act. Specifically, plaintiffs allege that a new review process – where applications are reviewed for alignment with agency priorities related to “gender ideology” and “diversity, equity, and inclusion,” among others – will unlawfully exclude qualified family planning providers and violate the Title X statute.
