Plaintiffs allege that the Department of Health and Human Services unlawfully imposed new funding conditions on the Teen Pregnancy Prevention (TPP) Program, resulting in the termination of existing grants  and jeopardizing future grants. Under the new HHS policy,  TPP Program awards are conditioned on incorporating abstinence-only sexual education. Grantees are also prohibited from engaging in “gender ideology” and “diversity, equity, and inclusion” practices.  Plaintiffs argue that the new funding conditions violate the Administrative Procedure Act and the First Amendment’s Free Speech Clause (viewpoint discrimination).
