Why This Matters: 

The plaintiff alleges that a physician partnership’s leadership program for Black physicians violates Section 1981 of the Civil Rights Act of 1866 and Section 1557 of the Affordable Care Act. Providing incentives to recruit physicians from underrepresented backgrounds can eliminate barriers to entry and improve quality of care for patients of color.

Potential Impact: 

Limiting providers’ ability to consider race in recruiting health care workforce could continue to hamper efforts to diversify such workforce, ultimately negatively impacting patient care and public health, especially for racial and ethnic minorities.
