Why this Matters:

The plaintiff alleges that a federal regulation broadening conscience exemptions for health care providers and threatening state and local funding — that would enable more patients to be denied access to reproductive health care services and other emergency services —violates the Administrative Procedure Act, the Spending Clause, and the Establishment Clause. The nondiscrimination protections included in the Affordable Care Act and under state law are critical to helping women and LGBTQI+ people access vital health care services.

Potential Impact:

Eroding nondiscrimination protections for women and LGBTQI+ people would exacerbate the challenges faced by marginalized groups, especially women and LGBTQI+ people, expose them to greater challenges in accessing needed services and care and further widen health gaps.
