Why this Matters
The plaintiffs, university professors and unions representing university faculty, challenge an Idaho law that criminalizes speech made by public employees supporting abortion, saying that the law violates their free speech right under the First amendment. They also argue that the law is vague because it does not clearly define what speech is prohibited and therefore violates the Due Process Clause. Free speech is a cornerstone of democracy and restricting dissemination of evidence-based health information will distort science and foster misinformation.
Potential Impact
Preventing public employees from speaking freely about reproductive health will chill free speech and prevent individuals from accessing much needed information to make decisions about their health.
